  16.      Definition of Shareware. . .

  18.           Shareware distribution gives users a chance to try software before
  19.      buying it. If you try a shareware program and continue using it, you are
  20.      expected to register. Individual programs differ on details -- some
  21.      request registration while others require it, some specify a maximum
  22.      trial period. With registration, you get anything from the simple right
  23.      to continue using the software to an updated program with printed manual.

  25.           Copyright laws apply to both shareware and commercial software, and
  26.      the copyright holder retains all rights, with a few specific exceptions
  27.      as stated below. Shareware authors are accomplished programmers, just
  28.      like commercial authors, and the programs are of comparable quality. (In
  29.      both cases, there are good programs and bad ones!) The main difference is
  30.      in the method of distribution. The author specifically grants the right
  31.      to copy and distribute the software, either to all and sundry or to a
  32.      specific group. For example, some authors require written
  33.      permission before a commercial disk vendor may copy their shareware.

  35.           Shareware is a distribution method, not a type of software. You
  36.      should find software that suits your needs and pocketbook, whether it's
  37.      commercial or shareware. The shareware system makes fitting your needs
  38.      easier, because you can try before you buy. And because the overhead is
  39.      low, prices are low also. Shareware has the ultimate money-back guarantee
  40.      -- if you don't use the product, you don't pay for it.

  75.           CMFiler is a copyrighted shareware program by Charles F. Martin,
  76.      President, NoVaSoft and author member of the Association of shareware
  77.      Professionals. The evaluation version of CMFiler is offered at no charge
  78.      to any potential user for evaluation.  Feel free to share it with your
  79.      friends, but please do not give it away altered or as part of another
  80.      system.  The essence of "user-supported" software is to provide personal
  81.      computer users with quality software without high prices, and yet to
  82.      provide incentive for programmers to continue to develop new products.

  84.           If you find this program useful and find that you are using CMFiler
  85.      after a 60-day trial period, you must make a registration payment of $30.
  86.      Checks may be made payable to Charles F. Martin or NoVaSoft.  You will be
  87.      sent by return mail a registered copy of the latest version of CMFiler
  88.      with hard copy of the user's manual.  You are thereby licensed to have as
  89.      many copies of CMFiler as you wish (for example, one on each computer you
  90.      use at home and work, plus one for your briefcase for troubleshooting
  91.      someone else's system), with the understanding that these are for YOUR
  92.      personal use and, if your wish, demonstration to others.  Please
  93.      recognize that this is a CONSIDERABLY relaxed condition on copying and
  94.      usage than some authors specify.  It is specified this way for YOUR
  95.      convenience.

  101.           Registration also entitles you to user support by mail or CompuServe
  102.      E-mail for at least one year, to a free copy by mail of the next major
  103.      update to CMFiler. Registration ALSO entitles you to a $10 cash
  104.      commission EACH time a new registrant uses the accompanying registration
  105.      form and cites you as the source of her/his evaluation copy of CMFiler.
  106.      Thus, not only do you get a truly fine utility packed with features, but
  107.      you may effectively reduce your registration fee, or even net some cash,
  108.      just by showing and offering the evaluation edition of CMFiler to others.

  111.      be added to an E-mail list and receive periodic upgrades of CMFiler by
  112.      CompuServe E-mail.  These files will be transmitted as binary files

  161.           As noted above, the basic "unit" of registration is the individual
  162.      user (as opposed, for example, to the individual machine), and the person
  163.      licensed to use CMFiler by virtue of this registration may have as many
  164.      copies on as many machines as he/she wishes, under the condition that
  165.      he/she reasonably assures that those copies are not regularly used by
  166.      others in a fashion that circumvents their obligation to also register.
  167.      This concept works fine for the individual user.  For a "corporate" user,
  168.      in which a company or school wishes to provide CMFiler as a workplace
  169.      resource for employees or students, the company's license may be extended
  170.      to a license for multiple users in any combination of two ways:
  171.  
  172.           1.  The single-user license conferred to the company or one of its
  173.      officials with the original $30 registration may be extended at any time
  174.      to any number of additional "unsupported" users at the rate of $7.50 per
  175.      additional user ($5 per additional student user for schools), with no
  176.      increment in the original benefits (ie., no additional hard copies of
  177.      manual will be sent, only one copy of the future upgrade will be sent and
  178.      technical support will be  provided only to the original registrant).

  180.           I recognize that the number of users afforded access to CMFiler in a
  181.      large company or network will vary as employees come and go and users are
  182.      added and subtracted, and so I ask only for a good-faith estimate, BUT
  183.      based on the total number of users afforded access, NOT on some lower
  184.      estimate of the number of users who might be using CMFiler
  185.      simultaneously.  Once the company or school extends its original
  186.      registration to additional unsupported users in this fashion, it may at
  187.      its own expense print this number of additional manuals and disks to
  188.      distribute to the addition users.  I have priced this license extension
  189.      so reasonably that this additional cost per additional user is affordable
  190.      for the smallest to the largest company, and represents a small fraction
  191.      of the workplace productivity gain benefiting each additional user.

  193.           2.   The original license may also be extended to additional
  194.      "supported" users at the rate of $15 per user, and I will send to the
  195.      original registrant one complete registration package (disk plus manual
  196.      and any current material fringe benefits) per additional user.

  198.           In either case of company license extension, the users added are
  199.      licensed to use CMFiler ONLY in the company's workplace for which the
  200.      license extension was purchased.  Any users who wish copies for their
  201.      personal use MUST individually register CMFiler with NoVaSoft.

  215.           Shareware Distribution. . .

  217.           Distributors and BBS sysops recognized by the Association of
  218.      Shareware Professionals (ASP) as adhering to its guidelines for shareware
  219.      distributors may begin offering CMFiler in their catalogs/BBS services
  220.      immediately, and will automatically receive updates by mail by virtue of
  221.      their ASP membership.  Other distributors whose only remuneration is a
  222.      nominal fee for the disk itself, and whose literature makes it clear to
  223.      their buyers that the program material must be separately registered with
  224.      the author, may also offer CMFiler immediately, but should inform me so
  225.      that I can provide them periodic updates.  Distributors who wish to sell
  226.      CMFiler packaged as or in a retail product must contact me, and are NOT
  227.      authorized to distribute CMFiler without prior approval.
